This web-portal (hereafter referred as “SMINE Resources or in short, SR”) developed and managed by SMISME Resources Sdn Bhd can be accessed through either www.smisme.org or www.smineresources.com and is designed for the purpose of providing information of products and services with the intention to assist Malaysian companies in creating better market exposure and market penetration within the internet cyberspace thereby develop global competitiveness.
Your Consent
By using SR you agree and accept to be bound by the Terms & Conditions set forth herein. When you voluntarily subscribe to either “FREE” and/or “PAID” Listings (hereafter referred as “Portal Listings”) you are expressly consenting to the collection, use and disclosure of your company’s general or product/services information which may be viewed by any visitor to SR. “FREE” Listing is generally known as “Company Profile Listing”; whereas “PAID” Listings are generally known as “Business Search Listing”, “Business Priority Listing” and “Promotion Slot”
On the contrary, if any of your Portal Listing (herein referred collectively as Name of Company; Company Registration Number; Nature of Business; Company Address; Telephone and Fax; Email and Website Address; Contact Person; Category selection in the Portal; Company Description; Products/Services Description; Pictures/Photos; Description of Promotion) are found in SR whereby you have not subscribe to any of the Portal Listing services, it is most likely being posted by SR customer service personnel with utmost good faith on the intension of helping your company to create better market exposure and market penetration. However we expressly state that we do not guarantee postings of any Portal Listing into SR by any member of the general public or any unauthorized personnel of your company.
At any point in time, if you do not consent to the collection, use and disclosure of your company’s general or product/services information as described above, you may write to us and we shall delete all your Portal Listings in SR.
Posting of Portal Listings
We are under no obligation to review any messages; information or content posted in SR by you and assume no responsibility or liability relating to any such Postings. Notwithstanding the above, we may at any time perform due diligence on the Postings in SR whereby we may decline to accept and/or remove any Postings that contain:
- any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially and ethnically provoking or offending, or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law;
- contents that offer unauthorized downloads of any copyrighted or private information;
- contents placed in different categories within SR by the same company restating the same information;
- contents of which the nature of business is not in tandem with the objectives and/or policies of SR.
Amendment to the Portal Listings
You can make any amendment or adjustment to update your Portal Listings wherever and whenever necessary as SR has a self-editing function.
Kindly update your Portal Listings with the latest data as frequent as possible.
Members Obligations
In consideration of your use of SR, you agree to: (a) provide true, accurate, current and complete information about your company and/or yourself and (b) maintain and promptly update your Portal Listings to keep it true, accurate, current and complete.
You are advised to maintain the confidentiality of the password you have created when you register your Portal Listings with SR. You agree to immediately notify us of any unauthorized use of your password or any other breach of security.
Privacy Notice - Collection and Use of Personal Identifiable Information
Your Personal Identifiable Information such as your name, contact number, email address, etc will be collected when you contact us, register with us, sign up to receive any information, complete a survey form, ask us a question or email us your feedback or comments, or wherever you are required to enter any such Personal Identifiable Information and when you take part in any promotions or contests conducted through SR.
We may also use your Personal Identifiable Information for other purposes such as customer service, fraud prevention and providing information that may be of interest to you and your business unless such sharing is prohibited by legislation.
When you register your Portal Listings, your Personal Identifiable Information such as your name, contact number and email is shown under the listing, and is accessible by the public at large. At any point in time, if you do not wish to reveal any such Personal Identifiable Information, you can delete such information with the self-editing function.
Other than those Personal Identifiable Information disclosed in your Portal Listings, we have put in place reasonably adequate safeguards to protect other Personal Identifiable Information that we have collected about you through other communication processes. We have also limit access to your Personal Identifiable Information about you to employees whom we reasonably believe need to have access to in order to diligently perform their job function. We also do not rent or sell your Personal Identifiable Information to the public at large. However, we may share your Personal Identifiable Information with affiliate or associate companies and/or trusted business partners.
In the event that we do share such collected information in accordance with this Privacy Notice, the recipients of such information will also be restricted to using the information only for the purpose for which it was disclosed and for no other unauthorized purposes.
We reserve the rights to send you periodic information via the email, fax and/or through the telephone medium. Such information includes but not limited to sales & marketing materials, portal activities and promotional information. If you do not wish to receive such information, you can write to us or simply choose to unsubscribe if sent through email.
Placement of Cookies
We reserve the rights to store information on your computer in the form of a "cookie" or similar file for the purpose of improving the content and functionality of the Portal. We do not use cookies to retrieve personal information from your computer unless you knowingly and willingly provide such information.
If you do not wish to receive cookies, you may set your browser to reject it or to alert you when a cookie is placed on your computer.
Legal Disclaimer
Though every effort is geared towards preserving your privacy, we may need to disclose your Personal Identifiable Information when required by law wherein we have good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on SR.
Copyright / Trademark
The trademarks, logos and service marks ("Marks") displayed on the Portal are the intellectual property of SMISME Resources Sdn Bhd and other relevant parties. You are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission except otherwise permitted to do so in certain approve activities of SR or such third party which may own the Marks.
All information and content including any software programs available on or through SR is protected by copyright. Your are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any content available on or through SR for commercial or public purposes.
We reserve the right to remove any content in SR which allegedly infringes another person's or company’s copyright.
Limitation of Liability
As the content in SR may be updated, changed or modified from time to time, users are advised to take the necessary actions to confirm the information available with the relevant party or parties. We will not in any circumstances be liable for any damages whatsoever including without limitation to general, incidental, special, indirect or consequential damages or damages for any loss of rights, loss of business or profits, loss of goodwill, loss of use of data, interruption of business arising from or in connection with the delivery, use or performance related to SR or the information contained in it whether by action in contract, tort or otherwise howsoever.

All the contents in SR are for general information purpose only and do not constitute any professional advice. You are deemed to have expressly agreed that the use of SR is solely at your own risk by assessing it. Prohibition
The contents, information, software components and other materials produced directly from SR may only be used for the sole purpose of sourcing information for own personal usage and strictly not for any commercial purposes that may be used in whole or in part for any business especially to generate income. Users are otherwise strictly not allowed to print, copy, broadcast, download, store (in any medium), transmit, adapt or change in any way the contents of the portal without obtaining prior permission. No Spam Policy
You understand and agree that sending unsolicited email advertisements to email addresses of the Portal Listings through the computer systems of SR is prohibited. Such actions may subject the sender and his /her agents to civil and criminal penalties.
Third Party Websites
SR contains hypertext links to websites created and maintained by other organizations or companies and are provided for the purposes of convenience only. We will not be responsible for the contents of such websites and shall not be liable for any loss or damages whatsoever arising from the use of or reliance on any such information by users who access these websites.
Websites that are hyperlink from SR may have their own data protection and privacy notices. Users are encouraged to consult the privacy notices of these other websites.
Changes to the Terms of Use
We reserve the rights at any time to make changes; add and/or delete clauses to the Terms of Use that governs the use of SR, and to refine the policies and update the contents of SR as a whole. The continual usage or access to SR shall be deemed as acceptance of these changes regardless whether any Notice of Changes has been made.
Violations of the Terms of Use
We reserve the rights to seek all remedies available at law and in equity for violations of these Terms of Use, including the right to block access from a particular Internet address to SR.
Applicable Law
Any claim relating to SR and the services provided through SR shall be governed by the laws of Malaysia, without reference to its choice of law provisions.
